    Case Study – excessive speeding…

    My client received a traffic ticket for going 105 mph in a 55 mph zone and had a ticket for running a stop sign on his license.  He was assigned to one of the toughest traffic ticket judges in NY.  The newspapers had reported the incident, which dramatically increased the possibility of jail time and his license being immediately suspended as the publicity would likely cause the judge to maintain his strict verdicts.  The client faced the embarrassment of a jail record, the inconvenience of losing his driving license, a total of 9 points, a 3-year assessed DMV fee, and a large insurance increase for 3 years.  The client immediately took a defensive driving course.  In the end, the client kept his license and avoided jail time from one of the strictest county traffic courts in NY.

    Case Study – speaking on a cell phone while driving

    My client came to me with a ticket for speaking on a cell phone while driving which carries 5 points in New York.  Attorney Ginsberg handled everything and appeared in court for the client.  Although he does not promise this result in all cases, he was able to negotiate a parking on pavement violation that carries no point.  The parking violation allowed the client to avoid both points and any 3-year insurance increase.  The fine which included all surcharges was $175.   Attorney Ginsberg strongly advised the client to get a blue tooth device and pull over to the side of the road if they needed to text anyone as he was sure a similar ticket in the near future would result in the 5-point ticket being fully enforced

    Yes, you can plead guilty, and you will be fined by the courts.  But, if you do, it will be treated as a conviction after a full trial and receive the points assigned to the violation, any surcharges and be subject to an insurance increase.
